This agreement is an official and public offer of the Seller, addressed to an unspecified circle of persons, to conclude a contract for the purchase and sale of goods remotely on the terms set out below.
1. General provisions
1.1. This document is a public offer in accordance with Article 633 of the Civil Code of Ukraine.
1.2. Acceptance of this offer is the Buyer's full and unconditional acceptance of the terms of this agreement by placing an order on the online store website.
1.3. The online store is the property of the sole proprietorship Bugayova Tetyana Oleksandrivna.
1.4. The seller reserves the right to make changes to the terms of this offer with prior publication on the website.
2. Terms and definitions
Seller – FOP Bugayova Tetyana Oleksandrivna, RNOKPP code 2639501228, engaged in entrepreneurial activities and sells goods through an online store.
Buyer – any legally capable individual who has accepted the terms of this offer and placed an order.
Goods – a list of products posted on the online store website.
Order – the Buyer's application for the purchase of the Goods is properly completed.
3. Subject of the contract
3.1. The Seller undertakes to transfer the Goods to the Buyer's ownership, and the Buyer undertakes to accept and pay for them.
3.2. The product is presented in electronic catalogs on the site. The appearance may differ slightly from the actual one.
4. Ordering procedure
4.1. The buyer places the order independently through the website.
4.2. After placing an order, the Seller confirms it via email or phone.
4.3. The seller has the right to refuse to fulfill the order in the event of a lack of goods, a technical error, or other reasons.
5. Price and payment method
5.1. The price of the product is indicated on the online store website.
5.2. Payment is made using one of the available methods:
- online via the LiqPay payment system;
- cash on delivery (if available).
5.3. The buyer is obliged to pay for the goods in full upon receipt, unless otherwise provided by the delivery method.
6. Delivery of goods
6.1. Delivery is carried out by Ukrainian delivery services (Nova Poshta, Ukrposhta, etc.).
6.2. The shipping cost is determined by the carrier.
6.3. The risks of accidental loss pass to the Buyer upon transfer of the goods to the carrier.
7. Return and exchange of goods
7.1. The buyer has the right to return or exchange the goods within 14 days, in accordance with the Law of Ukraine "On Consumer Rights Protection".
7.2. A return is possible if the product has not been used and has been preserved in its original condition.
7.3. Individually tailored goods created to the Buyer's order are not subject to return (Article 13).
7.4. In the event of a manufacturing defect, the Seller will exchange the item at its own expense.
8. Rights and obligations of the parties
The seller is obliged to:
- produce and deliver goods on time;
- ensure product quality;
- provide reliable information about the product.
The buyer is obliged to:
- provide accurate data when placing an order;
- pay for the goods;
- accept delivery.
9. Responsibility of the parties
9.1. The seller is not responsible for the actions of the carrier.
9.2. The Seller is not responsible for data incorrectly provided by the Buyer.
10. Data confidentiality
10.1. The information provided by the Buyer is used only to fulfill the order.
10.2. Personal data is processed in accordance with the Law "On Personal Data Protection".
11. Changes to the contract
11.1. The seller may make changes to the terms of the offer by publishing them on the website.
11.2. The buyer is considered to be aware of it from the moment of publication.
